Plano Health Insurance Faces Latest Legal Challenge to the Affordable Care Act.

Plano health insurance continues to face legal challenges from anti-Affordable Care Act activists who have been waiting for more than a decade for the long-embattled bill to be repealed in its entirety. The latest courtroom drama centers on a single thing: whether or not the federal government can require the employer-paid health insurance plans cover STD screenings and HIV prevention drugs at no out-of-pocket costs to subscribers. While this doesn’t seem horrible on paper, the fear is that by undermining preventative care for HIV and STDs, other preventative services might be caught in the crossfire and be subjected to similar limitations that would hinder what many Americans have come to expect.

Per the Kaiser Family Foundation in an article by Daily Kos, “The potential implications are much broader, however, if the Supreme Court revisits and revises the non-delegation doctrine and restricts Congress’ ability to delegate the development of very precise standards to federal agencies. Without allowing the agencies to update the recommended preventive services, Congress would have to pass a new law every time the USPSTF recommend a new preventive service in order for it to be covered without cost-sharing. Any decision that changes the standard for Congress’ delegation could limit agency discretion to address a broad range of health and other issues through regulation.”

Rick Thornton, a Plano health insurance agent , echoed the Daily Kos article by saying that rolling back the government’s ability to enforce care requirements could definitely impact millions of Americans who are already covered by private insurance. Time will tell what happens next, but Thornton said it is not wise to assume this latest legal challenge will fail just like all the rest.
